The Rule Making Process

The Rule Making Process

The ACH Rules are managed by the National Automated Clearing House Association (NACHA), along with its Direct Members (of which UMACHA is one). The rulemaking process begins with an idea that is vetted with the NACHA Rules and Operations Committee. If found to be a valid idea based on a business case, it is assigned to one of three NACHA Rules Work Groups (Risk and Compliance, Innovation, or Operations). The assigned group formulate draft rules that are then used to craft either a Request for Information or a Request for Comment that is distributed to the stakeholders in the network. If feedback is positive, the ballot is prepared and distributed to the Direct Members of NACHA for a vote. A super-majority (66-2/3) must vote to approve the ballot.

During the Request for Information or Request for Comment period, UMACHA's Rules and Technology committee review the information supplied by NACHA and file a comment. The UMACHA Board of Directors, consisting of 16 individuals, also review the ballot information and each submit their vote to UMACHA. The majority position is used to complete the UMACHA ballot, which is sent to NACHA.

There are FOUR types of releases in relation to the rule-making process:

  1. Request for Information (the gathering of information relating to the need for a rule)
  2. Request for Comment (the gathering of information to allow for understanding the impact of a proposed rule)
  3. Release of Proposed Rules Ballots (notifying of rules ballots up for a vote)
  4. Passed/Failed Ballots Releases (notifying of rules failed to be passed or rules passed and when they are to take affect)

  • 2015 NACHA Operating Rules Supplement #2-2015
    Recrediting Receiver - Removal of Fifteen Calendar Day Notification Time Frame, Clarification of RDFI Warranties for Notifications of Change, Disclosure Requirements for Point-of-Sale Entries, Minor Rules Topics which encompasses five minor changes, and new 2016 ACH Network Administration Fees.
  • 2015 NACHA Operating Rules Supplement #1-2015
    The Same Day ACH: Moving Payments Faster rule (Rule) will amend the NACHA Operating Rules (Rules)
    to allow for same-day processing of virtually any ACH payment. The Rule will enable ACH Originators that
    desire same-day processing the option to send same-day ACH transactions to accounts at any Receiving
    Depository Financial Institution (RDFI). The Rule includes a “Same Day Entry fee” on each Same Day ACH
    transaction to help mitigate RDFI costs for enabling and supporting Same Day ACH.

  • NACHA invites comments on two sets of proposed rules - Comments due August 23, 2019.

    NACHA invites comments to obtain industry feedback on a proposal to create an industry resource for financial institutions to be able to more easily connect with other financial institutions about ACH operations, exceptions and risk management.  All financial institutions participating in the ACH Network would register contact information with Nacha for personnel or departments responsible for ACH operations and fraud/risk management. Nacha would make a registry of financial institution contacts available to financial institutions to use in addressing and resolving ACH operations and risk management situations Responses are requested by Friday, August 23, 2019.  Please visit NACHA’s web site at https://www.nacha.org/rules/proposed to submit comments
